Project on Addressing Prison Rape

Michigan

  1. Policy: Michigan Department of Corrections Policy Directive 03.03.140: PREA and Prohibited Sexual Conduct involving Prisoners
  2. Language:
    1. All prisoners shall be assessed during an intake screening and upon transfer to another facility for their risk of being sexually abused by other prisoners or being sexually abusive toward other prisoners.  The OMNI-based risk assessment tools will be used to determine a prisoner’s risk.  The results of the risk assessment shall be considered when making housing, bed, work, education, and program assignments with the goal of keeping separate those prisoners at high risk of being sexually victimized from those at high risk of being sexually abusive.
    2. Staff shall complete a PREA-Aggressor Risk Assessment-Prison and a PREA-Victim Risk Assessment-Prison in accordance with the PREA Risk Assessment Manual.  Staff designated by the Warden shall complete both PREA Risk Assessments if any of the following occur:
      1. Within 72 hours of a prisoner’s arrival at a correctional facility, including intake.
      2. Whenever warranted due to a referral, request, incident of sexual abuse, or receipt of additional information that may increase the prisoner’s risk of being sexually abused by other prisoners or being sexually abusive toward other prisoners.
