Large money judgments may depend on qualitative assessments of foreign legal systems as a whole. Both transnational litigation and investor-state arbitration require adjudicators to decide on the fitness of foreign law at certain points. This presentation will critically discuss the evidence available for assessing Latin American legal systems in those contexts.
