Professor Senftleben’s paper discusses how the new EU Directive on Copyright in the Digital Single Market creates “a peculiar triangle of obligations to license, filter and privilege user-generated content (UGC).” The paper argues that that by abolishing the traditional safe harbour for hosting in the case of copyrighted content, “it may lead to the disappearance of the open, participative internet which EU citizens currently enjoy.” Looking forward, he proposes ways to avoid the loss of open, democratic avenues for online content creation, including “new use privileges that offer room for user-generated content without prior authorization on the other.”
A presentation of Professor Senftleben’s research will be followed by a roundtable discussion with US and international academics and policy experts on the impact of the EU directive on policy processes in other countries with comments from academics and experts from Canada, South Africa, Hong Kong and the United States.
